El Presidente Posted December 28, 2021 Posted December 28, 2021 Anecdotally at least, more and more councils/towns appear to be taking this up. How is your neck of the woods faring? ___________________________________________________________________________________________________ https://www.mv-voice.com/news/2021/12/28/mountain-views-ban-on-smoking-in-multifamily-residences-takes-effect-this-week Starting Saturday, Mountain View will begin enforcing a sweeping prohibition on smoking that affects all residents in apartments, condos and townhomes. The law marks the city's first major legislative crackdown on smoking in nearly a decade. The ordinance, which takes effect Jan. 1, prohibits smoking in multi-unit residences including inside units, on balconies and in common areas. The law is written broadly enough to cover a majority of Mountain View's housing, but stops short of including duplexes and single-family homes. 2

Hammer Smokin' Posted December 29, 2021 Posted December 29, 2021 yes, we have many apartment buildings (and condo's) that don't allow smoking.
Kaptain Karl Posted December 29, 2021 Posted December 29, 2021 That’s rich ass Mountain View for ya! 1
Popular Post chris12381 Posted December 29, 2021 Popular Post Posted December 29, 2021 They are just down the road from me. My town (San Mateo) actually already has this ordinance and includes duplexes but not single family homes. They also have banned all smoking in public. Public meaning city streets and sidewalks. That even includes the sidewalk in front of my home. Now, I have been walking my dog every day since this ordinance was enacted 7 years ago. I walk 2 miles along the sidewalk and through a city park. Only one old nasty man (from inside his home!) has ever said anything and started screaming at me, threatening hurt my dog, demanded I walk elsewhere, recorded the who thing and even started leaving crazy notes for me to read every time I walked by. He then started calling the police on me every time I walked by. I was polite to the officers, I explained what had been happening and how he was demanding I not use the public sidewalk and was threatening to hurt my dog. Initially, one officer suggested that I consider doing that but I made it clear I would not be responding to his threats by backing down. The other officers agreed. I told them all I do is walk my dog, enjoy my cigar and go home. The police mentioned the ordinance about smoking but they had no interest in enforcing it as a call out. That was a year ago. 10
Popular Post Nevrknow Posted December 29, 2021 Popular Post Posted December 29, 2021 That brings back memories. 2012? Had a loft in an upscale converted factory. Girl at the front desk had the unpleasant duty of informing everyone that we were going no smoking. Nice place but it “leaked” if you cheated. I sealed up mine and her places so we never got caught. Those were the days. Damn she was hot. And yes. Don’t ask. 😬 7
Monterey Posted December 29, 2021 Posted December 29, 2021 The next step is banning it at your own home. I was reading on a case where if your house is under a Home Owners Association, the "HOA" could actually ban you smoking in your own yard. I wish I could find the article, but it was challenged and upheld by the courts. It was brought on by a member of an HOA that didn't care for the smoke coming into their yard. So they complained to the HOA which then banned all smoking in peoples own backyard. I can almost guarantee this will become more common in the years to come. 2 1 4

HOA? Yea, we have one and our motto is KMA. 😂 2 1

Popular Post Fuzz Posted December 29, 2021 Popular Post Posted December 29, 2021 And yet your neighbour can cook the smelliest food on the planet, that will not only permeate your walls, floors, clothes and even your own skin, yet there is no ban on that. 8
BrightonCorgi Posted December 29, 2021 Posted December 29, 2021 I expect restrictions to keep mounting and mounting. Same type of hysteria, mindset, and train of thought as vaccinations mandates. Doesn't matter; just do as they (or I) say. Eventually you'll be fined for suspicion of smoking. How about being fined for previously smoking? 3
Kitchen Posted December 29, 2021 Posted December 29, 2021 This is one of the reason we are looking for a small farm out in the country to move to. About 65% of my work is done at home, and I'd much rather have the space to do whatever I want while getting away from nanny progressive policies, that have also brought us the highest record of murders in the City of Brotherly Love's history. Meanwhile, here in Abu Dhabi, I can smoke by the pool if I want. 2

They tried it here in Germany - was struck down by the courts. No way it would pass here .... Here the text in a Google search : In general, smoking is part of the contractual use of the rental property, including on the balcony and terrace. When concluding the rental agreement, a smoking ban can be agreed individually. A pre-formulated clause in the rental agreement is not enough or valid. A prospective tenant does not have to state whether he smokes. 3 1

The law does not apply to them. They are free to smoke whatever, where ever they want. Laws only apply to the class of people who could potentially put up a fuss to those in power. 1

That is such a sad sight what California has become. We lived out there in Santa Maria for a year back in 2002-2003 but moved back to the east coast as it was too hard being 2500 miles from all our family. You couldn't pay me to live there now. We are currently living in the Myrtle beach area of South Carolina and obviously since it's a big tourist destination there are plenty of cigar shops and lounges and the area seems plenty cigar friendly. I have not heard or read anything to the contrary. 1

Popular Post chris12381 Posted December 29, 2021 Popular Post Posted December 29, 2021 My mom lives in a condo in FL. About half of the place smokes. Some chowder head moved in about 2 years ago from Connecticut and got the HOA to pass a total ban on smoking. Even on balconies. My mom is 71, who occasionally pilfers a cigar from my coolers I keep at her place for long term aging, is a non-smoker. However, the day they passed the ban at her condo, she went to the convenience store and bought several cartons of cigarettes. Every night, she goes out on her balcony, lights it like a stick of incense, places it down in the ashtray and goes back inside. Doesn't take a single puff. Just makes sure the new neighbor knows someone is always flouting her ban. Found out today she'd convinced 5 others in the building to do the same thing. They've been "smoking" every night for the past 2 years too. 3 7
BrightonCorgi Posted December 29, 2021 Posted December 29, 2021 The whole "you don't have a right to potentially harm me" logic needs to be re-examined. 1

We moved here due to the fact my wife has a totally virtual job position with the defense contractor she is employed with. Also my mother has retired to this area from the northeast and she is getting older and her eyesight is getting worse. The brand new built house we are waiting on has taken 6 months instead of the quoted 4 months. People are moving here to the area in droves. Due to the pandemic many more work from home which allows for the freedom to leave the high taxed blue states for greener pastures. Can't say I miss Virginia. The farther from DC I am the better! In the 70's today with full sun! No more snow and cold. Cigar smoking practically all year around outdoors here! Love it 1
williamthewolf Posted December 29, 2021 Posted December 29, 2021 This thread really has me up in arms and pissed off at the state of things. Only getting worse. Stay strong brothers. 3
