I agree. Unfortunately while it looks good on paper, it doesn't really work with the average person's psychological makeup. I am a criminal defense attorney and this is my daily task, making sure that a jury of my client's peers in fact does presume my client innocent. I find that the majority, if not the vast majority, of people presume guilt and require that I prove innocence.

Prosecutors certainly presume my client guilty and most judges presume my client guilty despite their best efforts to appear otherwise. Average citizens believe where there is smoke there is fire.

It is a wonderful notion but sadly not a reality.
